Persistent Pursuit Crime under Turkish Penal Code (‘TPC’) Art. 123/A, entered into force on 27th May 2022, will be scrutinized. The elements of persistent pursuit crime will be analysed. The issue of interpretation as to the “persistency” requirement will be addressed particularly. While describing the elements of crime, the necessity to limit this provision, which is open to broad interpretation, will be explained. Additionally, correlation between the crime under TPC Art. 123/A and other types of crime will be revealed.
