Within the scope of the 247. Wednesday Seminar of AYBU Faculty of Law, Research Assistant Dr. Elif Hande Altıntaş-Açıkgöz, from Department of Private International Law, made a presentation on “International Jurisdiction in Violation of Personal Rights on the Internet under the Decisions of CJEU”.
In her presentation, Dr. Altıntaş-Açıkgöz referred the difficulties experienced in determining the jurisdiction in disputes that occur on the Internet due to the fact that the internet environment does not have a geographical context, and she gave details about three cases that have been brought before the CJEU. Through these cases, in case of violation of the personal rights of natural persons and legal entities on the internet; ‘the determination of the place, where the act was committed’ and ‘the place, where the tortious act took place’ were emphasized. Further, ‘the place, where the victim’s interests are located’ and ‘the places, where the data is accessible’ were highlighted. Then, the limitations made by the CJEU regarding the courts, where interim injunction requests can be made were mentioned.
