The 3rd of the Cross-Workshops of our Faculty has been held on the 16th of November 2021 and Res. Assist. Gözdenur Güllü presented the topic titled as ‘Application of the Legal Pre-emption Right in the Trademark’. Firstly, it was touched upon the legal pre-emption right and different kinds of this right. Then, it was evaluated if the trademark right would be subject to common ownership and discussed how to assert a legal pre-emption right in the scope of Turkish Industrial Property Code (*SMK) Art. 148/ III? Subsequently, it was comparatively examined ‘if the notification of pre-emption action was subject to any requirements as to form’ within the framework of the Turkish Civil Code and the Turkish Industrial Property Code. Finally, ideas have been exchanged with regard to the question of ‘on what basis is the liability for the loss of the pre-emption right’s holder, arisen from not notifying the pre-emption action?’
